General protections and adverse action vs unfair dismissal

Unfair dismissal and general protections address different problems. MAKIN Advisory helps employees and employers understand the distinction, assess the facts and choose a considered response to dismissal or other alleged adverse action.

The legal question matters

Unfair dismissal focuses on whether a dismissal was harsh, unjust or unreasonable within the applicable eligibility framework. General protections focus on adverse action taken for a prohibited reason. A situation may raise questions about both, but the claims are not interchangeable.

For example, disagreeing with a performance assessment does not itself establish a prohibited reason. Conversely, an apparently orderly process does not necessarily answer an allegation that a decision was made because someone exercised a workplace right.

How MAKIN Advisory can assist

  • Identify the decision or conduct at issue and the protection said to be involved.

  • Review the chronology, correspondence and decision-making evidence.

  • Explain possible pathways, deadlines and restrictions on overlapping proceedings.

  • Assist with preparing or responding to a Commission application.

  • Advise on negotiations, settlement terms and the implications of further proceedings.

Build a chronology around the decision

Useful evidence may include the relevant complaint or request, who knew about it, when a decision was considered and the reasons recorded at the time. Timing can be significant, but timing alone does not prove every element of a claim.

Employees should preserve material they lawfully hold and avoid filling gaps with assumptions. Employers should identify the actual decision-makers and retain the original records rather than attempting to improve the account afterwards. We can help organise the evidence around the legal questions it needs to answer.

Discuss a general protections or adverse action issue

Understand the process before choosing a claim

A general protections dismissal application ordinarily begins in the Commission, which assists with dispute resolution. If unresolved, further proceedings may involve a federal court, or Commission arbitration where the required consent and conditions exist. That is different from assuming the initial conference will decide liability.

The route affects preparation, cost and risk. Before lodging, assess the claim’s basis and the interaction with any other action already commenced. Before settling, understand the rights being released and the commitments each party will make.

General protections FAQs

What is adverse action?

It can include dismissal and other detrimental conduct in relevant workplace relationships. The legal issue also involves why the action was taken and whether a protected right or attribute is involved. Not every unwelcome workplace decision is unlawful adverse action.

Can I use general protections if I cannot claim unfair dismissal?

Not simply as a substitute. A general protections claim needs its own factual and legal foundation, including an alleged prohibited reason. Different eligibility rules do not remove the need to identify that foundation.

Is the deadline always 21 days?

A general protections application involving dismissal generally must be filed within 21 days after dismissal takes effect. Matters not involving dismissal follow a different pathway. Identify the actual claim and relevant dates promptly rather than applying one deadline to every workplace dispute.

Can I lodge both types of dismissal claim?

Restrictions on multiple proceedings can apply. Do not lodge several overlapping applications as a precaution without considering the consequences. Advice on claim choice is particularly valuable when time is short.

What should an employer do when an application arrives?

Read the Commission correspondence, note the response date and preserve evidence of the decision and its reasons. Consider both any eligibility issues and the substance of the allegations. A disagreement with the claim does not justify ignoring it.

What affects legal costs?

Costs depend on the stage, urgency, evidence and agreed work. An initial pathway assessment is different from assistance through negotiations or court proceedings. We can discuss scope once the issue and deadlines are clear.
